and as such, is a registered Service Provider, to carry out Risk Assessments,
chemical water treatment and cleaning and disinfection services. Further
details on the Legionella Control Association can be found at www.conduct.org.uk The control of Legionella (and avoidance of Legionnaire's disease) is a serious matter which involves every non-domestic property and facility in the country. Legislation is in place, under the Health & Safety at Work Act 1974 and the Control of Substances Hazardous to Health, which puts the responsibility for controlling any risk, squarely on the shoulders of the owner or operator of the property or facility. All water systems, to which the general public will be exposed, are included in the legislation and the HSE issued a Code of Practice & Guidance (L8) in 2001, "Legionnaires´ disease - The control of legionella bacteria in water systems".
Shops, hotels, cafes, retirement homes, schools, hospitals, museums, in fact, all buildings where water is stored and distributed in some way and, to which the public will have access, are covered by this legislation. Other, perhaps more unlikely facilities, such as amusement parks which may contain a water feature or fountain, are also included.
Ignorance of the legislation is no defense, should there be an occurrence or outbreak of Legionnaires´ disease. Owners and operators may employ external specialists to carry out work on their behalf, but must take reasonable care to ensure the competence of the service provider, to carry out this work.
The Legionella Control Association is an independent organisation, set up in full consultation with the Health & Safety Executive, which regulates Service Providers who are contracted to carry out work in the area of Legionella control, offering customers peace of mind when appointing a contractor.
